பொருள்

வெளியிட விலக்கு உள்ள தகவலையும், அதன் பொது நலன் தீங்கைவிட அதிகமாக இருந்தால் வெளியிட அனுமதிக்கும் விதி.

வெளிப்படைத்தன்மைச் சட்டங்கள் விலக்குகளைப் பட்டியலிடுகின்றன (பாதுகாப்பு, வணிக ரகசியம், தனிப்பட்ட தகவல்); ஆனால் பொது நன்மை அதிகமாக இருந்தால் – உதாரணமாக ஓர் அதிகாரியின் சொத்து அல்லது ஊழல் விசாரணை – விலக்குள்ள தகவலையும் வெளியிட இவ்விதி அனுமதிக்கிறது. இந்திய RTI சட்டத்தில் தனிப்பட்ட தகவலுக்குப் பிரிவு 8(1)(j)-க்குள்ளும், பொதுவாகப் பிரிவு 8(2)-இலும் இது இருந்தது. DPDP சட்டம், 2023-இன் பிரிவு 44(3) இதை (j)-யிலிருந்து நீக்கியது; இது இப்போது உச்ச நீதிமன்றத்தில் எதிர்க்கப்படுகிறது. புட்டசாமி விகிதாசாரச் சோதனையின் கீழ் தனியுரிமையையும் அறியும் உரிமையையும் சமன் செய்யும் நடைமுறைக் கருவி இது.

Meaning

A rule that allows information otherwise exempt from disclosure to be released when the public interest in it outweighs the harm.

Transparency laws list exemptions (security, commercial secrets, personal information), but an override lets the authority disclose exempt information when the public good is greater – for example, an official's assets or a corruption inquiry. India's RTI Act had it inside Section 8(1)(j) for personal information and, more generally, in Section 8(2). Section 44(3) of the DPDP Act, 2023 removed it from clause (j), which is now under challenge in the Supreme Court. It is the practical tool for balancing privacy and the right to know under the Puttaswamy proportionality test.
