Background

  • Law: the POCSO Act has been in force since 14 Nov 2012. Under Section 28, the State Government, in consultation with the Chief Justice of the High Court, designates a Court of Session in each district as a 'Special Court'. Trials should be completed, as far as possible, within one year (Section 35). The 2019 amendment allowed up to the death penalty for aggravated offences.
  • Constitution: Article 15(3) – State may make special provisions for women and children; Article 39(f) – protecting children from exploitation (Directive Principle); Article 39A – free legal aid.
  • Drug law: Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985. The Narcotics Control Bureau (NCB), set up under it in 1986, is the apex enforcement agency under the Union Home Ministry. The Centre's 'Fast Track Special Courts' (FTSC) scheme is for rape and POCSO cases.
